Course Reserve Policy

Milner Library Policy on Course Reserves

  1. The Course Reserve service at Milner Library is intended for the use of students, faculty, and staff of Illinois State University.
  2. Materials placed on course reserve will be at the initiative of instructors for the educational and non-commercial use of students.
  3. Materials on course reserve will be removed from the system at the end of the courses for which the materials are intended.
  4. Material on physical reserve will be available at the Reserve Desk on the main floor for a two hour checkout period, with a valid university ID.
  5. Material on electronic reserve will be accessible through the Milner Library web page, organized by class and instructor.
  6. Access to electronic course reserves from outside the ISU campus will require authentication by Illinois State University ULID and password.
  7. Users may make a single copy of a reserve item for private study, research, scholarship, or education.
  8. The library reserves the right to refuse to place materials on course reserve if it judges that the nature, scope, or extent of the material goes beyond reasonable boundaries of fair use.
  9. Each reserve item will display a copyright notice which reads as follows:

NOTICE: The copyright law of the United States (Title 17 U.S. Code) governs the making of photocopies of copyrighted materials. The person using this system is liable for any infringement.

Copyright and Course Reserves

Copyright policy regarding course reserves is based on the provisions of fair use of the United States Copyright Act of 1976. Section 107 of this act permits the making of multiple copies for classroom use. It identifies four factors for determining fair use:

  1. The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit purposes;
  2. The nature of the copyrighted work;
  3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. The effect of the use upon the potential market for or value of the copyrighted work.

Copyright Procedures

  1. Complete books will not be scanned into electronic course reserves.
  2. Materials which do not require copyright permission:
    • Exams, syllabi, and instructor's lecture notes
    • Government publications
    • A single journal article used for one semester
    • A single book chapter used for one semester
    • Works of art used for one semester
    • Material for which the professor or instructor owns the copyright
  3. Materials requiring copyright permission:
    • A journal article, magazine, or book chapter intended for use for more than one semester.
    • Multiple chapters from a single book or multiple articles from a single journal or magazine.
    • Artwork intended for use for more than one semester.
    • Out of print works
